Terms of Service

These terms govern the Range Flexibility website and Range iOS app, provided by Daniel Wainryb (“Range”, “we”, “us”). Contact us at daniel@rangeflexibility.com. Applicable mandatory consumer rights remain in force and take priority over any conflicting provision below.

1. Using Range

Range helps you measure and track physical flexibility using photos, angle measurements, progress records, and related fitness features. Use the service lawfully and only if you can enter a binding agreement or have the involvement and permission of a parent or guardian where required. Keep your account information accurate and protect access to your account.

You may stop using Range at any time and request account and data deletion as explained in the Privacy Policy. Any App Store subscription must be cancelled separately through Apple.

2. Fitness information and safety

Range is a fitness and progress-tracking tool, not a medical device or a substitute for qualified medical advice, diagnosis, treatment, or supervision. Measurements and automated image analysis can be inaccurate and should be checked by you. We do not guarantee any improvement, result, or level of measurement accuracy.

Consult a qualified healthcare professional before beginning a new exercise routine, particularly if you have an injury, medical condition, or other concern. Exercise within your abilities and stop if you experience pain or discomfort. Do not rely on Range to make a medical decision or delay seeking professional advice. Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable liability for personal injury.

3. Subscriptions and purchases

Some features require an App Store subscription. The price, billing period, trial conditions, and included features are shown before you purchase. Apple processes payments through your Apple account. A subscription renews automatically unless you cancel through your Apple subscription settings within the time stated at purchase. To avoid a renewal, cancel at least 24 hours before the current period ends.

Deleting the app or asking us to delete your data does not cancel your subscription. You can manage or cancel it in your Apple account settings. A trial may convert to a paid subscription at the disclosed price unless cancelled in time; any remaining trial may be forfeited when a paid subscription begins, as shown by Apple. Refund requests for App Store purchases are handled through Apple and remain subject to applicable consumer law. We will communicate material subscription changes and obtain agreement where required.

4. Your content

You retain ownership of the photos, progress records, and other content you provide. You give us only the permissions reasonably necessary to process, store, display, and otherwise use that content to provide the service you request, consistently with the Privacy Policy. You must have the rights and any permissions needed to provide the content, including permission from other people shown in it.

Keep your own copies of important content. We take reasonable care in operating the service, but you should not use it as your only archive. You can request deletion of your personal information as described in the Privacy Policy, subject to applicable retention obligations.

5. Acceptable use and intellectual property

Do not use Range to infringe others’ rights, upload unlawful content, introduce malicious software, access other users’ information without permission, or interfere with the service. Do not copy or exploit the app, branding, or other protected material beyond the use permitted by these terms and applicable law. These restrictions do not limit any non-waivable right you have, including lawful interoperability rights.

We grant you a personal, limited, non-exclusive right to use the service for its intended purpose. Other than your own content and third-party material, the service and its branding remain the property of their respective rights holders.

6. Availability, changes, and suspension

We may maintain, correct, or improve the service. We may restrict access where reasonably necessary to address unlawful use, a material breach, or a security risk, with notice and an opportunity to resolve the issue where appropriate. If we discontinue paid functionality or materially change it, we will provide the notice and remedies required by your contract and applicable law. These terms do not give us an unrestricted right to remove features you have paid for.

7. Responsibility and consumer rights

To the extent permitted by law, we do not promise uninterrupted or error-free availability or a particular fitness outcome. We are responsible for losses to the extent required by applicable law. Nothing in these terms limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited. Statutory guarantees, remedies, and cancellation or refund rights remain unaffected.

8. Apple and other services

App Store use and purchases are also subject to Apple’s applicable terms. Where applicable, Apple’s Standard End User License Agreement governs the app license; these terms supplement it for the Range service without overriding mandatory Apple provisions. Other linked services are provided by their own operators and have their own terms.

9. Changes and disputes

We may update these terms for changes in the service or law. We will provide appropriate notice of material changes and obtain agreement where required. An update does not retroactively change an existing dispute or remove mandatory rights. If you have a concern, contact us first so we can try to resolve it. Any applicable protections or rights to bring a claim in the courts of your country of residence remain available.
